1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of the blupxl website (the "Site") and related services, operated by Blue Pixel Software LLC ("we," "us," or "our"). "blupxl" is a brand and domain name under which Blue Pixel Software LLC operates. By accessing the Site or using our contact form, you agree to be bound by these Terms. If you do not agree, please do not use our services.

2. Who We Are

Blue Pixel Software LLC is a veteran-owned software company that operates under the blupxl brand. We provide custom software development, AI solutions, websites and web applications, system integration, and technical advisory services. Any project we undertake for you is governed by a separate written engagement agreement; these Terms cover your use of this website, not the delivery of a specific project.

3. Sign-In for Contact

To send a message through our contact form, you may sign in using a third-party provider (Google or Microsoft). This is used solely to verify your email address so we can reply to you; we do not create an account or store a profile for you. You are responsible for the content of any message you send and for providing an address you control.

4. Acceptable Use

You agree not to:

• use the services for any unlawful purpose or in violation of these Terms;
• attempt to gain unauthorized access to our systems;
• interfere with or disrupt the integrity or performance of the services;
• submit content that is unlawful, infringing, or that you do not have the right to share;
• use automated means to access the services in a way that burdens our infrastructure.

5. Engagements, Quotes, and Payment

This website does not process payments. Estimates and quotes provided through the site are non-binding. Any fees, payment terms, deliverables, and timelines for actual work will be defined in a separate written agreement between you and blupxl.

6. Intellectual Property

The Site and its content, features, branding, and functionality are owned by Blue Pixel Software LLC and protected by copyright, trademark, and other laws. You may not copy, modify, distribute, or create derivative works from our site content without our permission. Ownership of any work product created under a paid engagement is addressed in the applicable engagement agreement.

7. Third-Party Services

Our services rely on third parties, including authentication providers (Google, Microsoft), hosting and infrastructure providers, and (when enabled) an email delivery provider. Your use of features that depend on these providers may also be subject to their terms. We are not responsible for third-party services or content.

8. Disclaimers

The website is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the services will be uninterrupted, error-free, or secure.

9. Limitation of Liability

To the maximum extent permitted by law, Blue Pixel Software LLC and its members will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the website. Our total liability for any claim relating to the website will not exceed one hundred U.S. dollars ($100). Liability arising from a paid engagement is governed by the applicable engagement agreement.

10. Indemnification

You agree to indemnify and hold harmless Blue Pixel Software LLC from claims, damages, and expenses arising out of your misuse of the services or violation of these Terms.

11. Termination

We may suspend or terminate your access to the website at any time, with or without notice, if we believe you have violated these Terms or to protect our services. You may stop using the services at any time.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the services after changes become effective constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of the State of Nebraska, United States, without regard to its conflict-of-laws rules. Any dispute will be subject to the exclusive jurisdiction of the state and federal courts located in Nebraska.
